Terms of Use

1. Acceptance of Terms

By creating an account, submitting an ascent record, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. By using the Service, you represent that you meet this requirement.

3. Accounts

• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must provide accurate, current information when registering and keep it up to date.
• We may suspend or terminate accounts that violate these Terms, provide false verification information, or are used fraudulently.

4. The Service: Ascent Records & Verification

4.1 What We Provide

YourSummit allows users to submit records of mountaineering ascents and attempts and maintain a public or private profile of their climbing history. Verification of submitted records is an upcoming feature and is not yet available. Once live, verified records may be timestamped using independent timestamping services (e.g., OpenTimestamps) to establish a record of submission.

4.2 Verification Is Not a Guarantee

Verification reflects our review of the evidence and information you submit against our internal review process. It is not a legal certification, does not constitute proof beyond our platform's own standards, and should not be relied upon as the sole basis for any safety, insurance, employment, sponsorship, or competitive decision. Submitting a large volume of evidence does not guarantee a "verified" outcome; YourSummit may determine that a record is unverifiable even where substantial supporting data has been provided, based on our internal review standards. Verification status may be revised, suspended, or revoked if we later determine submitted information was inaccurate, incomplete, or fraudulent.

4.3 User-Submitted Content

You retain ownership of the content you submit — including photos, videos, links, descriptions, GPS data, and any other material ("User Content"). By submitting User Content, you grant YourSummit a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, create derivative works from, publicly display, publicly perform, and distribute that User Content, in whole or in part, in any media now known or later developed, in connection with operating, promoting, and marketing the Service — including on public profile pages if you choose to make records public, in YourSummit's own marketing and social media channels, and in aggregated or derivative features (such as trend maps or elevation graphics) that may incorporate your User Content.

This license continues for as long as your User Content remains on the Service, and survives with respect to any copies already distributed, published, or incorporated into derivative or aggregate features prior to removal. You are solely responsible for User Content you submit and represent that you have the right to submit it and that it does not infringe any third party's rights.

5. Payments

Certain verification services will be offered, once available, on a paid, per-record basis. Prices will be displayed at the time of purchase and are subject to change prospectively. Payments will be processed by a third-party payment processor (currently Stripe); YourSummit does not directly store your full payment card details. See our Privacy Policy for details on payment data handling.

Except as required by law or as otherwise stated at the time of purchase, verification fees are non-refundable once a verification review has been completed, regardless of outcome.

6. First Ascenders & Promotional Programs

From time to time, YourSummit may offer promotional programs (such as the "First Ascenders" program) that provide free or discounted access to certain users. Any such program is governed by its own supplemental terms, which do not grant equity, financial compensation, or ownership interest in YourSummit or Assure eServices, Inc. unless explicitly and separately stated in a signed written agreement.

7. Acceptable Use

You agree not to:

• Submit false, fabricated, or misleading ascent or verification information;
• Impersonate another person or misrepresent your affiliation with any person or entity;
• Use the Service to harass, defame, or harm another user;
• Attempt to reverse-engineer, scrape at scale, or interfere with the security or normal operation of the Service;
• Use the Service for any unlawful purpose.

8. Intellectual Property

The Service, including its software, design, branding, and all content we create (excluding User Content), is owned by Assure eServices, Inc. and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. MOUNTAINEERING IS AN INHERENTLY DANGEROUS ACTIVITY; YOURSUMMIT DOES NOT PROVIDE SAFETY, MEDICAL, OR MOUNTAINEERING ADVICE, AND USE OF THE SERVICE IS NOT A SUBSTITUTE FOR PROPER TRAINING, GUIDANCE, OR JUDGMENT IN THE MOUNTAINS.

10. Limitation of Liability

To the maximum extent permitted by law, Assure eServices, Inc. and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Assure eServices, Inc. from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your User Content.

12. Changes to the Service or Terms

We may modify these Terms or the Service at any time. Material changes will be communicated via the Service or email. Continued use after changes take effect constitutes acceptance of the revised Terms.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access for violation of these Terms, at our discretion, with or without notice.

14. Governing Law & Disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Massachusetts, and you consent to personal jurisdiction there.
